Family Files Wrongful Death Suit Against Lancaster Police, City, County In Police Shooting of Ricardo Muñoz

CHICAGO, Feb. 11, 2021 /PRNewswire/ — Seeking justice for her son and hoping to hold local officials accountable in order to prevent future tragedies, Miguelina Peña filed suit in federal court on Monday, naming the police officer who shot her son, as well as the former police chief, city and county as defendants.

Ms. Peña’s son, Ricardo Muñoz, 27, was fatally shot after his family contacted police for their help during a mental health episode last year. Mr. Muñoz, who had been diagnosed with schizophrenia and bipolar disorder in his early 20s, was well-known to the local police department, whom his family had turned to repeatedly for help in similar situations.

On Sept. 13, Mr. Muñoz’s family had again called the crisis intervention hotline when Ricardo became agitated and was experiencing a psychotic episode. Following instructions from the crisis intervention operator, they then called the local non-emergency police number for assistance as well as 911.

Local police dispatched Officer Karson Arnold to the Muñoz family residence. Within minutes of the Officer Arnold’s arrival, Ricardo Muñoz was dead: shot multiple times by the officer in front of his home as his mother, Ms. Peña, watched in horror.

Attorneys Steven Levin, Daisy Ayllon and Julie Murphy from Levin & Perconti in Chicago are representing the Muñoz family, along with attorneys Michael Perna and Ryan Borchik of Perna & Abracht in Chester County, Pennsylvania.

The suit, which comes in the wake of local officials’ decision not to file charges against Officer Arnold in the matter, notes that the city and county had no proper procedures in place to deal with people in mental health crises and that the officer failed to make any attempt to de-escalate the situation or use less-lethal means to bring Mr. Muñoz to safety.

«Ricardo’s death was, at best, the predictable result of ill-advised and clumsy police work—and heart-breakingly preventable.  At worst, it was the direct result of a cynical and callous disregard for the well-being of one of society’s less fortunate sons,» said attorney Michael Perna.

Citing the city’s deficient policies concerning officer supervision and training, attorney Daisy Ayllon  added, «Ultimately, Ricardo’s lawsuit is about mental health reform, about police accountability when dealing with mentally-disturbed individuals who have committed no crime, and about the prevention of similar tragedies as a direct result of untrained and heavy-handed police intervention.»

«Sometimes a community must look beyond itself for justice, and that’s what the federal courts are for. We are looking to shine a light upon the system failures in responding to this call for help,» said attorney Julie Murphy

In December, U.S. Senator Bob Casey (D-PA) introduced two bills calling for reform in how police nationwide respond to people with mental health issues and other disabilities. Casey referenced the Muñoz case, along with two other police shootings of mentally ill men in Pennsylvania, as he announced the legislative initiative. In Philadelphia, days of demonstrations, including some protests that escalated into violence, had followed the October police shooting of Walter Wallace, who, like Muñoz, suffered from mental illness.

«To their astonishing credit, rather than venting anger while in the grip of anguish, Ricardo’s family actively discouraged violence in the immediate aftermath of his killing, which spared the city of Lancaster yet more tragedy,» said attorney Ryan Borchik.

The Muñoz family’s lawsuit seeks damages for Ricardo’s pain and suffering – including the denial of medical attention after he was shot – and his wrongful death as well as the emotional distress inflicted upon his mother as she witnessed his killing and the physical injury she suffered when, following her son’s fatal shooting, she was tackled against a police vehicle.

«Ricardo’s family first looked to a local crisis center for help with his well-documented mental health condition, but instead the police arrived and within a few short minutes had shot and killed their son and brother. Next the family looked to local law enforcement for transparency and accountability, but instead they encountered a most condescending response from the District Attorney and no transparency. Now they look to the federal court for justice,» said Steven Levin.

The legendary 16th hole will also live on at the 86th edition of «The People’s Open,» though modified from previous years. Soar in a hot air balloon with Rainbow Ryders or Hot Air Expeditions, horseback ride at Saguaro Lake Guest Ranch or with Wandering Heart Adventures, or kick it into high gear on an ATV tour with Stellar Adventures.

FRESH BITES
THE BIG NEWS: Amid the pandemic, Scottsdale has continued to defy the odds with the opening and sustaining of myriad new restaurants since spring 2020 – including Pizzeria Virtú, FRANCINE and Benjamin’s Upstairs to name a few, just in the downtown area alone. The city’s business owners have also found new ways to dine safely and make up for lost revenue during temporary shutdowns with new allowances from the Governor’s office as of Dec. 2, 2020, for restaurants to expand outdoor seating into parking lots and sidewalks, as seen in many major US cities.

FIVE NEW WAYS TO SIP + SAVOR:

Available at select locations on Fridays and Saturdays, late-night noshers can expect all the Hash Kitchen staples, including the build-your-own bloody mary bar, bubbly Boba mimosas and cereal shooter flights.
  • Trendy Fox Restaurant Concept, Culinary Dropout, opened a location at Scottsdale Quarter in Oct. 2020. The new, spacious restaurant brings a lively, open-air atmosphere for enjoying a casual meal and delighting in lawn games.
  • Z’Tejas, with restaurants only in Arizona and Texas, is scheduled to open a new restaurant in Scottsdale in Feb. 2021. Classic Z’Tejas dishes like sizzling Santa Fe Enchiladas and Diablo Pasta appear on the menu, along with seasonal southwestern offerings, and its signature margaritas and tequila flights.

PORTLAND, Ore., Feb. 11, 2021 /PRNewswire/ — Portland General Electric (NYSE:POR) today announced that Intel (NASDAQ:INTC) has joined PGE’s Green FutureSM Impact program. Intel’s participation is enabling PGE to enter into a 15-year agreement with Avangrid Renewables, a subsidiary of AVANGRID, Inc. (NYSE:AGR), to purchase clean, emissions-free energy from a new 138-megawatt solar facility that will be developed in Wasco County, Oregon. Intel’s purchase is the single largest in PGE’s program; the company joins 17 other businesses and municipalities that have committed to purchase clean power through the Green Future Impact program, filling the program’s original 300-megawatt capacity.

Intel signed a 15-year agreement with PGE to enable the development of this additional new solar facility, which it is naming Daybreak Solar. It will produce a significant portion of the energy needed to power Intel’s advanced technology development and manufacturing facilities in Hillsboro, Oregon. Intel will be the only purchaser of power from this new facility and as part of the agreement, will also purchase and retire the associated renewable energy credits from Avangrid Renewables to improve the quality of its 100% renewable U.S. energy supply. Since 2004, Intel has been the largest purchaser of PGE’s Green Future Enterprise (formerly Clean Wind) product.

«Intel is excited to facilitate the construction of this new solar facility and provide our Oregon facilities with locally-based renewable energy,» said Marty Sedler, director of Global Utilities and Infrastructure for Intel Corp. «We are proud to extend our commitment to sustainability and to advancing Oregon’s economy.»

Avangrid Renewables will develop the 138-megawatt project in Wasco County, Oregon on 1,100 acres of privately owned land. During peak construction, it will create an estimated 150 to 200 jobs in partnership with local unions. When the facility begins operating in 2022, it will produce enough power to serve the equivalent of over 32,000 homes. It will benefit the local economy for years to come by generating an estimated $30 million of taxes and property owner lease payments over the life of the project.

«We are pleased to again partner with PGE as we continue to meet the growing clean energy demand of forward-thinking commercial customers in the Pacific Northwest,» said Holly Carias, vice president of origination for Avangrid Renewables. «This project represents an important step forward in the region’s clean energy transition.»

PGE’s agreement with Avangrid Renewables marks the second local renewable energy project made possible by Green Future Impact customers. In 2020, PGE and Avangrid Renewables announced the development of a 162-megawatt solar facility – the largest in Oregon – to meet the needs of 17 Green Future Impact subscribers. That project is expected to come online in late 2021.

«PGE is excited to work with Intel to enable their ambitious sustainability and climate goals through our Green Future Impact program,» said PGE vice president and Chief Customer Officer John McFarland. «Partnerships like this strengthen Oregon’s economy and also help advance PGE’s goal to reduce the emissions associated with the power we serve to customers by at least 80% by 2030. We look forward to working with Intel and Avangrid Renewables for years to come.»

PGE has requested approval from the Oregon Public Utility Commission to add 200 megawatts of installed renewables to the program to meet customer demand. More information about participating in Green Future Impact is available at  www.portlandgeneral.com/greenfutureimpact

CHARLOTTESVILLE, Va., Feb. 11, 2021 /PRNewswire/ –Two writers who have delved into the past and present challenges facing treasured places on the Southeast coast will receive the 2021 Phillip D. Reed Environmental Writing Awards from the Southern Environmental Law Center. SELC will present the awards March 25 during this year’s Virginia Festival of the Book.

In the book category, former Georgia state legislator Paul Bolster will receive the Reed Award for Saving the Georgia Coast: A Political History of the Coastal Marshlands Protection Act. In the journalism category, Tony Bartelme of The Post and Courier in Charleston will receive the Reed Award for his in-depth reporting on South Carolina’s coastal environment, including communities where the damaging impacts of climate change are happening now.

The featured speaker for the Reed Award presentation will be Lulu Miller, co-host of WNYC Studios’ Radiolab and author of the widely acclaimed Why Fish Don’t Exist, a nonfiction scientific thriller and memoir. The free, online event will be at 2 p.m. Eastern Time. To register to receive a link to the Zoom session, visit www.southernenvironment.org/reedaward/.

This Year’s Book Award Winner: Paul Bolster

In Saving the Georgia Coast, published by the University of Georgia Press, Paul Bolster brings to life the unlikely coalition of local residents, wealthy landowners, hunters and anglers, garden club members, courageous politicians and others who came together more than 50 years ago to defend Georgia’s unspoiled coastal marshlands. At the same time, he traces the intricate legislative maneuvers that resulted in passage of the 1970 Coastal Marshlands Protection Act, a law that remains the most comprehensive protection of marshlands along the Atlantic seaboard.

Bolster, who served a diverse Atlanta district in the Georgia House of Representatives for 12 years, does more than look back at this landmark legislative achievement. He also examines the policy challenges facing the Georgia coast today, among them how to address unrelenting development pressures and how to deal with rising sea levels and other impacts of a warming planet. He continues to follow environmental legislation in the state capitol and feels that lawmakers could look to the lessons from 50 years ago as a guide to protecting Georgia’s fragile coast today.

A free-lance writer and historian, Bolster holds a Ph.D. degree in history from the University of Georgia and a law degree from Georgia State University School of Law. He taught American history at Clark Atlanta University for 14 years and has worked as a lobbyist for the Georgia Hospital Association and the American Hospital Association. A tireless advocate for affordable housing, he ran a Health Care for the Homeless program in Atlanta and served for three years on Governor Nathan Deal’s Council on Criminal Justice Reform.

This Year’s Journalism Award Winner: Tony Bartelme

Tony Bartelme, a special projects reporter for The Post and Courier, is being recognized in part for his stories from the Rising Waters Project, a series documenting how the accelerating forces of climate change are affecting Charleston and the South Carolina Lowcountry. Bartelme explains not only the science behind wetter hurricanes, intense «rain bomb» events and flooding high tides, but also the policy issues they raise and how they are making life harder for many South Carolinians. In other pieces recognized by this year’s award, Bartelme displays a gift for linking science with sense of place. These include a story tracing the human and natural history of South Carolina’s Santee Delta, and another on the quest by researchers to learn more about an elusive and rapidly disappearing marshland bird, the eastern black rail.

A graduate of Northwestern University’s Medill School of Journalism, Bartelme is a three-time finalist for the Pulitzer Prize and has won some of the highest honors in journalism. He was awarded a prestigious Harvard University Nieman Fellowship in 2010.  His investigative reporting has exposed government corruption and has explored subjects ranging from changes in ocean plankton to the global shortage of doctors. His latest book, A Surgeon in the Village: An American Doctor Teaches Brain Surgery in Africa, was published by Beacon Press.

This Year’s Featured Speaker: Lulu Miller

Lulu Miller is a Peabody Award-winning science journalist who fell hard for radio when she joined the staff of WNYC Studios’ Radiolab, initially as a volunteer. She returned to the show as co-host this past year. She is also co-founder of NPR’s Invisibilia, a show about the invisible forces that shape human behavior. Her book Why Fish Don’t Exist has been hailed as a wondrous debut and was listed among the best books of 2020 by The Washington Post, NPR, Chicago Tribune and Smithsonian. It follows the life of taxonomist David Starr Jordan—the first president of Stanford University and a proponent of the eugenics movement—and reveals both the triumphs and the dark side of his relentless search for order in a chaotic world. Her book is also a deeply personal story about how to go on when everything seems lost. Miller is a graduate of Swarthmore College and earned an MFA in fiction writing from the University of Virginia.

China Automobile Tire Industry Report 2021: Manufacturers, Exports, Imports, Production, Industry, 2017-2025

DUBLIN, Feb. 11, 2021 /PRNewswire/ — The «Research Report on the Automobile Tire Industry in China,…

DUBLIN, Feb. 11, 2021 /PRNewswire/ — The «Research Report on the Automobile Tire Industry in China, 2021-2025″ report has been added to ResearchAndMarkets.com’s offering.

Research and Markets Logo

According to this report, China’s automobile industry has developed rapidly since the access to WTO. China has been the world’s largest automobile manufacturer and distributor for 12 years from 2009 to 2020. In the meanwhile, China is as well the world’s largest producer and exporter of automobile tires.

Demand for automobile tires can be classified into OEM demand from whole-vehicle manufacturing and replacement demand from automobile aftermarket. In developed countries, there is scarce potential for growth of new automobile sales due to the high market saturation. Therefore, the demand for aftermarket becomes the major driving force of the tire industry.

The analyst figures out two factors that drive the automobile tire industry in China: domestic market and export demand. On the one hand, both production volume and reserve volume of automobiles continue to grow in China. In 2019, the production volume of automobiles reached 25.72 million, representing a CAGR of 6.4% from 2009 to 2019. In 2019, the automobile reserve volume exceeded 1.9 million, representing a CAGR of 15% from 2012 to 2016. These two figures were far higher than the global average figures.

On the other hand, the remarkable cost advantage of Chinese tires over international competitors is correlated with an upward trend of tire export from China. In 2016, the export volume of Chinese automobile tires was 3.31 million and the export value was USD 11.46 billion. Continuous increases in the export of Chinese tires have led to huge international trade barriers faced by Chinese tire export enterprises. However, the cost advantage of Chinese tires is favorable to maintain the export volume at a high level in a short time.

The analyst states that China has established an integrated tire industry chain. Except for natural rubber mainly relying on imports, there are a large number of manufacturers of other raw materials of tires such as synthetic rubber, steel cord and carbon black in China. Chinese enterprises are also competitive in producing tire molds, manufacturing machines, etc. Some major global tire manufacturers have entered China and they perceive China as an important global production base. Nowadays in China, over half of the domestic tire market is dominated by foreign-invested enterprises. Moreover, these foreign-invested enterprises occupy most market shares of OEM for whole vehicles that are highly profitable.

According to incomplete statistics by the analyst, the number of Chinese tire manufacturers has exceeded 500 by the end of 2020. A majority of domestic tire manufacturers are characterized by small-scale enterprises that produce in a small volume, facing risks of closing down or being acquired. In order to avoid increasing domestic labor costs and trade barriers, some domestic tire manufacturers start to acquire tire enterprises or establish plants overseas. A survey by the analyst demonstrates that enterprises such as Sailun Jinyu Co., Ltd., Linglong Group, Zhongce Rubber Co., Ltd. and Double Coin Holdings Ltd. have established tire plants in Thailand, Vietnam, etc.

Although China has been the world’s largest new automobile market since 2008, automobile reserves per capita remain low, with the automobile reserve volume being less than 200 per thousand persons and lower than the figure of 600-1000 per thousand persons in developed courtiers. It is estimated that China’s annual economic growth rate will remain over 5% from 2021 to 2025. The production and sales volume of tires will present an annual growth rate of about 5%. Similarly, the automobile reserve volume will continue to climb, stimulating domestic demand for tires.

According to this analysis, the outbreak of the COVID-19 epidemic has had an adverse impact on China’s tire manufacturing industry in the first quarter of 2020. However, since April 2020, China’s tire manufacturing industry has gradually recovered. Although due to the impact of the epidemic, global and Chinese automobile production has declined, reducing the demand for tires in the new car market, the demand for tires in the aftermarket remains high. In 2019, China’s tire export volume was about 500.6 million, and the CAGR from 2015 to 2019 was about 3%. The analyst expects that due to the impact of the COVID-19 epidemic in 2020, China’s tire exports will slightly decline.

From 2021 to 2025, the CAGR of China’s tire exports will remain at least 2%. The analyst predicts that the biggest risk facing China’s tire industry in the future is due to the rising costs of China’s manpower, land, and energy, causing tire manufacturing companies in China to move to Southeast Asian countries such as Vietnam.
