Americans Gave Up Citizenship in Record Numbers in 2020, Up Triple From 2019, Reports Tax Specialists Americans Overseas

AMSTERDAM, Feb. 4, 2021 /PRNewswire/ — 2020 was a record year for Americans giving up their citizenship, according to the experts and tax specialists of Americans Overseas.

  • A record 6,705 Americans gave up their citizenship in 2020
  • A 260% increase from 2019 when 2,577 Americans gave up their citizenship
  • Renunciations triple despite U.S. consulates being closed for large parts of the year due to COVID-19
  • This is the highest year on record; the previous record was 5,411 cases in 2016

There are an estimated 9 million U.S. Americans living overseas. Every three months the U.S. Government publishes the names of all Americans under the IRS rules (section 6039g), who give up their citizenship. 2020 saw 6,705 Americans renounce their citizenship, 260% more than 2019 when 2,577 Americans renounced. This number possibly would have been higher if U.S. Embassies worldwide had not been closed for large parts of the year due to COVID-19 regulations. If this trend continues 2021 renunciation numbers will be record-breaking.

Surprisingly enough, it’s not only politics that drive renunciations but also a law called Foreign Account Tax Compliance Act (FATCA). This law forces banks outside the U.S. to report all American account holders under threat of astronomical fines. Banks now want to rid themselves of U.S. clients as they pose a liability. Many Americans living outside the U.S. are therefore forced to renounce and provide a Certificate of Loss of Nationality (CLN) to keep their banking services.

U.S. citizens that renounce must pay a $2,350 government fee and appear in person at the U.S. Embassy in their country of residence. In addition, a complete tax return must be filed and exit tax might be owed. Despite these obligations, there has been a growing trend of U.S. citizens renouncing.

«A law intended to catch tax evaders inside the U.S. is now dragging innocent Americans living outside the U.S. down. Lobbying efforts by the EU have so far not led to any change in policy by the U.S.,» says Daan Durlacher, partner at Americans Overseas.

Ironically, the U.S. stimulus checks of $1,200 + $600 are also being used towards the cost of renouncing – a difficult, irreversible decision with a profound impact on an individual’s life, especially in these difficult, special times.

Legislation filed in the House Thursday would bar foreign aid for government entities that the U.S. government determines to have egregiously violated journalists’ human rights, and it would require sanctions on individuals who participated in such acts.

The bill, named «The Jamal Khashoggi Press Freedom Accountability Act of 2021,» was authored in the House by Rep. Adam Schiff, D-Calif. A companion measure was offered in the Senate last year by Democratic Sens. Patrick J. Leahy of Vermont and Amy Klobuchar of Minnesota. Khashoggi, a Saudi Arabian Washington Post columnist, was killed in October 2018 in Turkey by agents of Saudi Crown Prince Mohammed bin Salman. 

Meanwhile, a separate bill unveiled in the Senate on Thursday would direct the U.S. State Department to establish an ambassador-at-large for press freedom and train foreign-service officers on how to promote media independence and protect foreign journalists. The bill, «The Global Press Freedom Act,» was written by Sens. Todd Young, an Indiana Republican, and Brian Schatz, a Hawaii Democrat.

In 2020, 21 journalists were killed because they reported the news, according to the Committee to Protect Journalists. Several other indicators of press independence and safety have shown declines of late.

If passed, all California state contracts involving commodities that put tropical and primary boreal forests at risk, such as palm oil, soy, cattle, rubber, paper/pulp and timber, would require contractors to maintain a No Deforestation, No Peat, No Exploitation (NDPE) policies, and provide evidence that their operations in sensitive tropical and boreal regions are not linked to forest destruction and degradation or abuses of indigenous peoples’ rights.

Environmental advocates and industry leaders alike agree that such policies are the best way to prevent ongoing forest destruction. A version of the bill introduced in 2019 achieved strong bi-partisan support but failed to pass the Senate Appropriations Committee.

The world’s forests are in crisis. Tropical forests cover roughly seven percent of the Earth’s surface but harbor close to half of all species on Earth. An estimated 18 million acres of forest—an area one-fifth the size of California—is lost every year, largely due to the expansion of agribusiness plantations. Tropical deforestation and related land-use changes are responsible for nearly a quarter of global carbon dioxide emissions, and are a major contributor to the global biodiversity crisis.

Boreal forests account for one-third of the world’s forested areas and, after mangroves, are the most carbon-dense forests on earth. The Canadian boreal forest alone stores twice as much carbon as the world’s oil reserves and is the nesting ground for billions of migratory birds. Logging in primary forests is driving significant carbon impacts and species declines. In North America, only 15 of 51 boreal caribou herds have sufficient habitat to survive long-term, primarily as a result of industrial logging, while 33 percent of boreal birds have declined in the last 50 years.
