Hicks Thomas Successfully Navigates Clean Water Act Enforcement Action Brought by San Francisco Baykeeper

The lawsuit, filed in January 2020 by the non-profit corporation San Francisco Baykeeper, claimed that the company’s Bay Area industrial facility violated the Clean Water Act by discharging polluted stormwater that exceeded U.S. Environmental Protection Agency and California standards for certain metals and suspended solids.

The company turned to Hicks Thomas’ northern California office, which then collaborated with the firm’s veteran team of environmental litigators in Houston.

The Hicks Thomas team negotiated a consent decree that enabled implementation of the business solution with minimal penalties or fees.

Hicks Thomas also worked with the company to navigate multiple challenges at the site, determining that the best and most cost-effective approach would be to consolidate the stormwater runoff and all the existing discharge points to one location for treatment.

After less than four months, the system installation was completed and deemed effective when zero exceedances were reported after the first significant rain event.

Nearly 27,000 rooms were added to the region’s development pipeline in 2020 alone, in addition to the signing of Marriott’s largest branded residences project with close to 4,200 units.

NUEVA YORK, 18 January 2021 /PRNewswire Policy/ — Un grupo social al que no se tiene en cuenta de inmediato al pensar en este problema es el de las personas migrantes y refugiadas.

La postura de la Organización Internacional de las Migraciones (OIM) se basa en un principio fundamental: se ha de garantizar al acceso a los servicios de salud para todos los migrantes sin importar su estatuto legal.

Así nos lo cuenta el director general de la Organización, António Vitorino, quien en una entrevista para Noticias ONU despeja los interrogantes sobre cuáles son las recomendaciones del organismo para este colectivo dentro de los planes de vacunación de los países.

“Los países tienen que prever la vacunación de todos los que están presentes en su territorio incluyendo a los migrantes, independientemente de su estatuto legal. No se trata de crear una prioridad para los migrantes. Al revés, se trata de aplicar a los migrantes los mismos criterios que se aplican a los ciudadanos nacionales. Es decir, aquellos que son más vulnerables por la edad o por razones de salud”, explicó.

Un derecho humano y un beneficio para todos

Vitorino recordó que la salud es un derecho humano y que también es de interés para la comunidad de acogida que toda la gente presente en su territorio esté sana, segura y se les preste los cuidados de salud esenciales. “También hay que garantizar el acceso a la vacuna a los migrantes”, destacó el máximo responsable de esta agencia de la ONU.

Sin embargo y ante la desconfianza de los migrantes a acceder a estos servicios ante una posible detención o deportación, explicó que los gobiernos han de dar las garantías necesarias de que el acceso a los cuidados de salud no suponga la aplicación de las leyes de inmigración.

El mensaje de Vitorino ante el escepticismo que pudieran tener los migrantes y refugiados a vacunarse de COVID-19 fue que “en este momento delante de un virus tan destructivo, hay suficiente evidencia científica y médica que nos permite decir que las vacunas disponibles son vacunas seguras y por eso yo apoyaría e incentivaría a que los migrantes y las personas que se desplazan sean vacunadas”, afirmó.
